مذكرة اتفاقية بين حكومة الجمهورية اللبنانية ومؤسسة الشرق الادنى

The Government of the Republic of Lebanon, hereinafter

referred to as the Government and the Near East Founda-

tion referred to hereinafter as the foundation have

agreed in a mutual effort to initiate existing projects

and to undertake various new projects which will lead

to the development of rural life in various Lebanese

agriculture areas, and in order to achieve this objec-

tive the Foundation will provide technical assistance to

both Agriculture Extension and Education Services of the

Ministry of Agriculture.

The implementation of projects will be available to the

various areas of Lebanese at location mutually agreed

upon between the Government represented through the

Ministry of Agriculture and the Foundation.

The Government and the Foundation both agree to the

establishment of a committee for administration of proj-

jects to be mplented and consisting of representatives

of the Ministry of Agriculture and the Near East

Foundation.

The committee will be responsible for teh following:

1. Selection and approval of specific projects

2. Estimation and approval of expenses for the projects

3. Procuring of supplies and equipement for projects

4. Devising ways and means by which the projects can be

improved or enlarged.

5. Recooend assignement pof personnel required for

projects

6. Maintaining liaison and working relationship with all

agencies and departments concerned with the projects.

As to the qualifications and tasks of Non-Lebanese

specialists, they will be professionnal and experienced

technicians. Upon selection by the Near East Foundation

a brief resume will be submitted to the Ministry of

Agriculture for concurrence before appointment. The

specialist or technician will take an active participa-

tion in developing and implementing the programs of pro-

jects as agreed upon with the Ministry of Agriculture.

Financial responsabilities will be outlined each year in

the budgets of projects agreed upon.

All materials and equipments purchased with projects

funds offered by the Foundation will become the property

of the Ministry of Agriculture upon completion of work

on these projects.

Also when assistance of the Foundation is no longer nee-

ded, the responsability and administration of projects

will be transferred to the Ministry of Agriculture.

In order to facilitate the operations mentioned herein,

the Government agrees to permit the import of equipments

materials, and machinery or other commodities which

shall be imported or yudchased from free zone by the

foundation of its use in projects and will be exempted

rom all taxes and duties, on condition that those im-

ports will be dedicated to support the Ministry of

Agriculture in the Agricultural Extension and Education

fields.

The Government agrees to exempt household equipment and

personnal furnishings, imported by employees of the

Foundation other than Lebanese upon their first entry to

Lebanon from customs fees, and it shall be permitted for

eacfh one of those employees to import one motorcar

which will be accepted under temporary entry all throu-

ghout the time in which its owner is working for the

Foundation and carrying on his work in Lebanon.

The Government agrees to exempt all assests and property

of the Foundation which are necessary for the purposes

of its offices and activities, and also motorcars,

wages, and compensation paid to its employees other than

Lebanese from all taxes, duties and any other kind of

fees or taxes.

Either party may terminate this agreement by deelaring

its wish to do so in writing to the other party on a

three months notice.

ان حكومة الجمهورية اللبنانية المشار اليها فيما يلي بكلمة "الحكومة" ومؤسسة الشرق الادنى المشار اليها بكلمة "مؤسسة"

اتفقتا في مسعى مشترك منهما لدعم المشاريع القائمة حاليا وتنفيذ مشاريع جديدة مختلفة والتي من شأنها ان تهدف الى تنمية الحياة الريفية في مختلف المناطق الزراعية اللبنانية ومن اجل بلوغ ذلك الهدف تقدم المؤسسة المساعدة الفنية لكل من دائرتي الارشاد والتعليم الزراعي في وزارة الزراعة.

ان تنفيذ المشاريع سيتم في كافة المناطق اللبنانية ضمن مواقع يتم تحديدها والاتفاق عليها من قبل الحكومة الممثلة بوزارة الزراعة والمؤسسة.

توافق الحكومة والمؤسسة على تأليف لجنة للاشراف على تنفيذ المشاريع من موظفين يمثلون وزارة الزراعة ومندوبين عن المؤسسة وتنحصر مهمة اللجنة في الامور التالية:

1- اختيار مشاريع محددة والموافقة عليها.

2- تقدير اكلاف المشاريع والموافقة عليها.

3- تأمين الحصول على المواد والمعدات اللازمة للمشاريع.

4- دراسة ووضع الخطط التي من شأنها تنمية وتوسيع المشاريع

5- التوصية بتعيين الموظفين اللازمين لتنفيذ المشاريع

6- تأمين الاتصال وحسن علاقة العمل مع كافة الادارات الرسمية المهتمة لمثل هذه المشاريع.

اما في ما يعود لمؤهلات اعمال الاخصائيين الفنيين الذين هم من غير اللبنانيين فيجب ان يكونوا من الاشخاص المشهود بخبرتهم الطويلة ومعرفتهم الواسعة ولدى اختيارهم من قبل المؤسسة سترسل خلاصة عن مؤهلاتهم لوزارة الزراعة كي تقترن بموافقتها قبل التعيين وسيشارك الاخصائي او الخبير الفني مشاركة فعالة في وضع وتنفيذ برامج المشاريع المتفق عليها مع وزارة الزراعة.

ان الاعباء المالية لتنفيذ العمل تحدد سنويا في موازنة المشاريع المتفق عليها.

ان جميع الاجهزة والمعدات التي ابتيعت من الاموال التي خصصتها المؤسسة للمشاريع تصبح ملكا لوزارة الزراعة لدى انتهاء العمل في تلك المشايع وكذلك ايضا عند عدم الحاجة لمساعدة المؤسسة تتحول مسؤولية وادارة العمل لوزارة الزراعة.

وتسهيلا للاعمال المشار اليها في هذه الاتفاقية, توافق الحكومة على ادخال التجهيزات والادوات والاليات او غيرها من البضائع التي تستوردها المؤسسة او التي تبتاعها من المنطقة الحرة, لاستعمالها في المشاريع معفاة من كافة الرسوم والضرائب بما فيها الرسوم الجمركية والبلدية ورسوم المرفأ او غيرها من الرسوم, شرط ان تكون هذه المستوردات مخصصة لمؤازرة وزارة الزراعة في اعمال الارشاد والتعليم الزراعي.

توافق الحكومة على اعفاء الامتعة والاثاث الشخصي التي استوردها سائر موظفي المؤسسة من غير اللبنانيين لدى اول دخول لهم الى لبنان من الرسوم الجمركية, ويصرح لكل من هؤلاء الموظفين باستيراد سيارة واحدة تقبل تحت وضع الادخال المؤقت طيلة مدة انتساب صاحبها للمؤسسة المذكورة وقيامة بالعمل في لبنان.

توافق الحكومة على اعفاء جميع الاموال والممتلكات العائدة للمؤسسة والتي هي ضرورية لمكاتبها ونشاطها وكذلك ايضا السيارات والرواتب والتعويضات المستحقة لموظفيها غير اللبنانيين من جميع الضرائب والرسوم وخلافها.

يحق لاي من الطرفين انهاء مفعول هذه الاتفاقية وذلك باعلان رغبته للطرف الثاني خطيا واعطائه مهلة ثلاثة اشهر للتنفيذ

وقعت في بيروت في 11 حزيران سنة 1969
