مذكرة اتفاقية بين حكومة الجمهورية اللبنانية ومؤسسة فورد

ان حكومة الجمهورية اللبنانية المشار اليها فيما يلي بكلمة "الحكومة" ومؤسسة فورد المشار اليها بكلمة "المؤسسة"

اتفقتا في مسعى مشترك منهما لانماء المواد الغذائية العالمية على التعاون في مشروع للابحاث الزراعية والانتاج.

ان الاهداف الاساسية لمشروع الابحاث الزراعية والانتاج هي زيادة انتاج الحبوب الغذائية والحبوب العلفية وتحسين تربية الاغنام بالطرق التالية:

1 - ادخال نباتات وسلالات حيوانية جديدة لابحاث اقليمية.

2 - ادخال وانماء ودراسة طرق انتاجية جديدة.

3 - اعطاء التسهيلات اللازمة لتدريب الاشخاص العاملين في مشاريع الابحاث الزراعية والانتاج.

وبالرغم من ان المشروع سيكون مركزه في لبنان فمن الجدير بالذكر ان كثيرا من نتائج هذه الابحاث يمكن تطبيقها في مناطق اخرى علما بان احدى اهداف هذا المشروع هي تسهيل تبادل النتائج المنبثقة عن الابحاث والمعلومات الاخرى المرتبطة بالزراعة بين مختلف المناطق.

ان مشروع الابحاث الزراعية والانتاج سيتم بالتعاون مع مصلحة الابحاث العلمية الزراعية في لبنان التي مركزها تل العمارة مع الاشارة الى انه يمكن لتنفيذ هذا المشروع استعمال الاراضي والامكانات المتوفرة لدى هذه المصلحة في مراكز تل العمارة وتربل وكفردان ضمن نطاق يتم تحديده والاتفاق عليه بين المصلحة والمؤسسة.

توافق الحكومة على متابعة جهودها لتقوية مصلحة الابحاث العلمية الزراعية وزيادة عدد البحاثين فيها بغية تأمين فعالية المشروع كما توافق ايضا على انتقاء فنيين من وزارة الزراعة او مؤسسة زراعية حكومية اخرى للمساهمة في مشروع انتاج الحبوب الغذائية والاغنام في لبنان.

توافق الحكومة على استيراد وتصدير التجهيزات والادوات والاليات والمواد الزراعية والحيوانية اللازمة لنجاح مشروع الابحاث الزراعية والانتاج معفاة من كافة الرسوم والضرائب بما فيها الرسوم الجمركية والبلدية ورسوم المرفأ.

ان المؤسسة توافق ضمن نطاق امكاناتها المتوفرة للانماء الزراعي على مساندة مشروع الابحاث الزراعية والانتاج بالاسايب التالية:

1- توفير فنيين للعمل في المشروع.

2- توفير الاعتمادات لشراء اجهزة اضافية ومعدات لازمة لانماء المشروع.

3- توفير الاعتمادات لتشييد ابنية اضافية قد يتطلبها المشروع.

4- توفير الاعتمادات اللازمة لتنظيم دورات تدريبية ومحاضرات وللقيام ببعض التصليحات وبناشاطات اخرى يتم الاتفاق عليها مسبقا.

جميع الاجهزة والمعدات ما عدا المواد الوراثية تصبح ملكا لمصلحة الابحاث العلمية الزراعية وتبقى مخصصة للمشروع.

كما ان الابنية التي قد تشيد في المستقبل لاستعمالها الخاص تصبح هي ايضا ملكا لمصلحة الابحاث العلمية الزراعية ولكنها تبقى معدة لاستعمالها في المشروع.

اذا رغبت المؤسسة في تاريخ لاحق في تشييد ابنية لاسكان موظفيها في تل العمارة او في اي مركز اخر تابع لمصلحة الابحاث العلمية الزراعية, تعطى هذه المؤسسة اذنا بممارسة الملكية والاستعمال الخاص لهذه الابنية لزمن معين يتم الاتفاق عليه بين المؤسسة ومصلحة الابحاث العلمية الزراعية.

توافق الحكومة والمؤسسة على ان مصلحة الابحاث العلمية الزراعية تمثل الحكومة في ما يتعلق بوضع وتنفيذ مشروع الابحاث الزراعية والانتاج. ويجدر بالذكر انه يمكن تعديل وزيادة هذه الاتفاقية بموافقة الطرفين المعنيين.

يعمل بهذه الاتفاقية لمدة عشر سنوات تجدد تلقائيا ما لم يعلن احد الطرفين رغبته في الغائها وذلك قبل سنتين على الاقل من تاريخ انتهاء مفعولها.

(1) ان المرسوم رقم 11639 تاريخ 9 كانون الثاني 1969 المتعلق بهذه المذكرة نشر في العدد 3 من الجريدة الرسمية الصادر بتاريخ 9 كانون الثاني سنة 1969.

MEMORANDUM OF AGREEMENT Between

THE GOVERNMENT OF THE REPUBLIC OF LEBANON

and THE FORD FOUNDATION

The Government of the Republic of Lebanon, hereinafter

referred to as the Government, and The foundation,

hereinafter referred to as the foundation, in a mutual

effort to heip increase the world's food supply, hereby

agree to cooperate in the development of an Agricutural

Research and Production Program.

The basic objectives of the Agricutural Research and

Production Program will be to increase the production of

basic food and feed grains and to improve sheep husbandry

by: introducing new plant nimal genetic material for

adaptive research; introducing, developing and testing new

production practices; and providing training facilities for

persons engaged in research and production programs.

Although the Program will be based in Lebanon, it is anti-

cipated that many of the research findings will be appli-

cable elsewhere in the region and one of the objectives of

the Program will be to facilitate the exchange of research

results and other information relating to agriculture

throughout the region.

The Agricultural Research and Production Program will be

conducted in cooperation with the Lebanese Agricutural

Resaerch Institute with headquarters at Tel-Amara and the

lands and facilities of the Lebanese Agricutural Research

Institute at Tel-Amara, Turbol, and Kfardan may be used for

conduct of the activities of the Program in such ways and

to such extend as may be agreed upon by the Institute and

the Foundation.

The Government agrees to continues its effort to strengthen

the Lebanese Agricutural Research Institute and to increase

the professional staff necessary to make the Program

effective. The Government also agrees to make available

selected staff of the Ministry of Agriculture or other

agricutural agencies of Government to assist with the food

grain and sheep production program in Lebanon.

The Government agrees to permit the import and export of

equipment, instruments, machinery and plant and animal

genetic material necessary for the success of the Agri-

cutural Research and Production Program, exempt from all

taxes and duties, including customs, municipal and prot

duties.

The Founfdation, within the limits of its resources,

available for agricutural development, agrees to support

the Agricutural Research and Production Program by providing:

(1) scientific staff to work on the Program.

(2)funds for the purchase of additional equipment, supplies

and materials required for an expanded research and

production program,

(3) funds for such additional bulding

facilities as may be required for the Program, and

(4)funds for such regional training programs, conferences,

workshops and other activies as may be agrees upon.

All equipment and materials, except for genetic materials,

will become the property of the lebanese Agricutural

Research Institute and will remain available to the Program

Any facilities that may be constructed in the future for

special use by the Program also will become the property of

the Lebanese Agricutural Research Institute, but will

remain available to the Program.

if, at some future date, it is deemed desirable for the

Foundation to construct residential quarters at Tel-Amara

or other stations of the Lebanese Agricutural Research

institute for use by the staff of the Foundation will be

granted permission to retain title to such property and the

inclusive right of use during a period of time to be agreed

upon by the Foundation and the Lebanese Agricutural

Research Institute.

The Government and the Foundation hereby agree that the

Lebanese Agricultural Research Institute shall represent

the Government in the implementation and operation of the

Research and Production Program. It is also understood that

this agreement may be amended with the consent of both

parties.

The period of this agreement shall be for ten years and

will automatically continue unless either party indicates

its desire to terminate the agreement at least two years

prior to the renewal date.
