المادة 22

ان الدائن المرتهن يلزمه ايضا ان يستوفي الدين المقدم تأمينا عند استحقاقه ويرد الى الراهن عند الاقتضاء الفرق الزائد بين المبلغ الذي قبضه والمبلغ الواجب له.

Art. 22. - Le créancier gagiste est également obligé de recouvrer la créance mise en gage lorsqu’elle vient à échéance. Il restitue au constituant, s’il y a lieu, l’excédent de ce qu’il a recouvré sur ce qui lui est dû.
