المادة 1055
لا يجوز الا لمن له اهلية التفرغ بدون عوض , ان يقيم نفسه كفيلا. ولا تصح الكفالة من القاصر ولو باذن ابيه او وصية اذا لم يكن له مصلحة في القضية التي يكلفها.
Art. 1055 - Nul ne peut se porter caution s’il n’a la capacité d’aliéner à titre gratuit.
Le mineur ne peut se porter caution, même avec l’autorisation de son père ou tuteur, s’il n’a aucun intérêt dans l’affaire qu’il garantit.
