لا تصح كفالة الموجب الذي لا يستطيع الكفيل ان يقوم فيه مقام المديون الاصلي كالعقوبة البدنية.
Art. 1058 - On ne peut cautionner une obligation que le fidéjusseur ne pourrait acquitter au lieu du débiteur principal, telle qu’une peine corporelle.
