لا دعوى للدائن على الكفيل الا اذا كان المديون الاصلي في حالة التأخر عن تنفيذ الموجب .
Art. 1070 - Le créancier n’a d’action contre la caution que si le débiteur principal est en demeure d’exécuter son obligation.
