المادة 195
ان سبب الموجب يكون في الدافع الذي يحمل عليه مباشرة على وجه لا يتغير وهو يعد جزءا غير منفصل من العقد كالموجب المقابل في العقود المتبادلة والقيام بالاداء في العقود العينية ونية التبرع في العقود المجانية. اما في العقود ذات العوض غير المتبادلة فالسبب هو الموجب الموجود من قبل مدنيا كان او طبيعيا.
Art. 195 - La cause d’une obligation réside dans le mobile qui la commande directement et uniformément et qui fait partie intégrante du contrat, à savoir, dans les contrats synallagmatiques, l’obligation correspondante; dans les contrats réels, la prestation effectuée; dans les actes onéreux unilatéraux, une obligation préexistante, civile ou naturelle.
