المادة 346
لا يجوز للدائن ان يعدل مقدما عن حكم مرور الزمن ولا أن يطيل او يقصر مدته وانما يجوز له أن يعدل عنه بعد الحصول عليه. ويكون عدوله صريحا او ضمنيا. واذا كان لعدوله صفة الاحتيال حاز لدائنيه ان يحصلوا على ابطال ذاك العدول باقامة الدعوى البوليانية.
Art. 346 - Le créancier ne peut renoncer d’avance à la prescription, ni en proroger ou en abréger les délais, mais il peut renoncer à la prescription, une fois acquise.
Sa renonciation peut être expresse ou tacite.
Si elle présente un caractère frauduleux, les créanciers du renonçant peuvent en obtenir la révocation au moyen de l’action paulienne.
