يتحمل البائع مخاطر المبيع في مدة سفره الى ان يستلمه المشتري, ما لم يكن هناك نص مخالف .
Art. 399 - Sauf stipulation contraire, la chose vendue voyage aux risques du vendeur jusqu’à sa réception par l’acheteur.
