المادة 46
موجب الاداء هو الذي يكون موضوعه اما دفع مبلغ من النقود او اشياء اخرى من المثليات , واما انشاء حق عيني.
Art. 46 - Il y a obligation de donner lorsque l’obligation a pour objet, soit le paiement de sommes d’argent ou d’autres choses ayant le caractère de choses fongibles, soit la constitution d’un droit réel.
