بموجب القرار عد 1769 الصادر في 20 ك2 سنة 1928 ورغما عن تطبيق المادة 31 من- القرار عدد 188 الصادر في 15 آذار سنة 1926 والمادة 17 من القرا رقم 188 الصادر- في 15 آذار سنة 26 كل شخص يحصل على حق عيني ضمن الشروط المعينة في احكام المادة 13 من القرار عدد 188 الصادر في 15 آذار سنة 1926 يبقى له هذا الحق وفي هذه الحال يكون لاصحاب الشأن في حال الغبن الحق في اقامة دعوى شخصية بالعطل والضرر على مسبب الغبن
