تفرض هذه الضريبة ويجري التحقق منها وفقا لأحكام الـمرسوم الإشتراعي رقم 144/59 وتعديلاته (قانون ضريبة الدخل(، وأحكام القانون رقم 44 تاريخ 11/11/2008 (قانون الإجراءات الضريبية).
