كل شريك في شركة تضامن من يعد كأنه يتعاطى بنفسه التجارة تحت عنوان شركة- فكل منهم يكتسب صفة التاجر القانونية. وافلاس الشركة يؤدي الى الافلاس الشخصي لكل من الشركاء.
