المادة 105
اذا قضي باقفال المحل لان المستثمر قد باشر استثماره في محل اقامته دون ترخيص الزم باخلاء المحل, وذلك مع الاحتفاظ بحق المؤجر الحسن النية في فسخ عقد الاجارة وفي كل عطل وضرر.
Art. 105: Lorsque la fermeture de l'etablissement est ordonnee parce que l'exploitation a ete entreprise sans autorisa- tion au domicile meme de l'exploitant, celui-ci sera tenu d'evacuer les lieux.
Sans prejudice du droit du bailleur de bonne foi a la resiliation du bail et a tous dommages interets.
