المادة 253
يجب لاستحقاق بدل العطل والضرر:
اولا- ان يكون معزوا الى المديون
ثانيا- ان يكون الضرر قد وقع ضرر
ثالثا- ان يكون قد أنذر المديون لتأخره فيما خلا الاحوال الاستثنائية.
Art. 253 - Pour qu’il y ait lieu à dommages-intérêts, il faut:
1 - Qu’un dommage ait été causé;
2 - Que ce dommage soit imputable au débiteur.
3 - Que le débiteur, sauf exception, ait été mis en demeure.
