المادة 368
ان مديري وحراس السجون او المعاهد التأديبية او الاصلاحيات وكل من اضطلع بصلاحياتهم من الموظفين اذا قبلوا شخصا دون مذكرة قضائية او قرار قضائي او استبقوه الى ابعد من الاجل المحدد يعاقبون بالحبس من سنة الى ثلاث سنوات .
Art. 368: Les directeurs et gardiens des etablissements penitentiaires ou disciplinaires ou des maisons de reeducation, et tous fonctionnaires en remplissant les attribution, qui auront recu un individu sans uandat ou decision de justice, ou l'auront retenu ou dela du terme, seront punis d'un emprisonnement d'un an a trois ans.
