المادة 38
تحتفظ وزارة البيئة بحق التدقيق في حسن التزام منشأة استرداد و/أو معالجة النفايات الخطرة و/أو التخلص النهائي منها بشروط الترخيص البيئي المُعطى لها. في حال تبين أن المنشأة قد خالفت شروط الترخيص البيئي والشروط المذكورة في المادة (36) من هذا المرسوم ، يتخذ بحقه الإجراءات المذكورة في الباب السادس من القانون رقم 444/2002.
The Ministry of Environment reserves the right to audit whether the hazardous waste recovery and/or treatment and/or final disposal facility complies with the environmental licensing requirements. In case, the facility is found to have violated the conditions of the environmental license and the conditions mentioned in Article (36) of this Decree, it should be sanctioned according to the procedures mentioned in Section VI of Law No. 444/2002.
