المادة 40

Holders of environmental licenses referred to in Article 39 above shall:

Provide a financial guarantee to the Ministry of Environment, to be determined by a decision issued by the Minister of Environment according to its type, form and value.

If the holder of the environmental license does not fulfill the obligations, conditions and activities imposed on him during or at the expiry of his environmental license, the Ministry of Environment shall execute them at his own expense, out of the value of the guarantee subject of this article.
