تعديلات على اتفاقية المنظمة البحرية الدولية

ان الجمعية،

اذ تستذكر ان وفودا عديدة قد اعربت، في دورتها العادية السابعة عشرة، عن قلقها بشأن نتائج انتحابات المجلس لفترة السنتين 1992- 1993،

واذ تلاحظ ان المجلس قد انشأ، في دورته الثامنة والستين، فريقا عاملا مخصصا مفتوحا لجميع اعضاء المنظمة للنظر في تعديلات محتملة على الاحكام التى تنظم الانتخابات في المجلس،

واذ تلاحظ بارتياح ان التنقيحات اللازمة على اتفاقية المنظمة قد صيغت داخل المنظمة ودرست بحسن نية ووفاق واعتمدت بالاتفاق العام للاعضاء،

وقد نظرت في التعديلات على اتفاقية المنظمة التي اوصى بها الفريق العامل المخصص المعني بالانتخابات في المجلس والتي وافق عليها المجلس في دورته التاسعة والستين،

1- تعتمد التعديلات على المواد 16 و17 و19 من اتفاقية المنظمة البحرية الدولية التي ترد نصوصها في ملحق هذا القرار،

2- تطلب الى الامين العام للمنظمة بأن يودع التعديلات المعتمدة لدى الامين العام للامم المتحدة تمشيا مع المادة 67 من اتفاقية المنظمة، وان يستلم صكوك القبول والتصريحات حسبما تنص على ذلك المادة 68،

3- تدعو اعضاء المنظمة بأن تقبل هذه التعديلات في اقرب موعد ممكن بعد ان تستلم نسخا منها، وذلك عن طريق ارسال صك القبول المناسب الى الامين العام تمشيا مع المادة 68 من الاتفاقية.

تعديلات على اتفاقية المنظمة البحرية الدولية

الجزء السادس- المجلس

المادة 16

يستعاض عن نص المادة 16 بما يلي:

"يتألف المجلس من اربعين عضوا تنتخبهم الجمعية".

المادة 17

يستعاض عن نص المادة 17 بما يلي:

"تراعي الجمعية، عند انتخاب اعضاء المجلس، المعايير التالية:

(أ) ان يكون عشرة اعضاء من الدول ذات المصالح العظمى في تقديم خدمات النقل البحري الدولية،

(ب) ان يكون عشرة اعضاء من الدول الاخرى ذات المصالح العظمى في التجارة الدولية المحمولة بحرا،

(ج) ان يكون عشرون عضوا من الدول غير المنتخبة، في ظل الفقرة (أ) او (ب) اعلاه، وذات المصالح الخاصة في النقل البحري او الملاحة البحرية، على أن يضمن انتخابها للمجلس تمثيل جميع المناطق الجغرافية الرئيسية في العالم ".

الماد ة 19 (ب)

يستعاض عن نص المادة 19 (ب) بما يلي:

"(ب) يتشكل نصاب المجلس من ستة وعشرين عضوا من اعضائه ".

AMENDMENTS,TO THE CONVENTION ON THE

INTERNATIONAL MARITIME ORGANIZATION

THE ASSEMBLY

RECALLING that at its seventeenth regular session several delegations expressed concern about the outcome of the elections to the Council for the 1992-1993 biennium,

NOTHNG that the Council at its sixty-eighth session established an Ad Hoc working group open to all members of the Organization, to consider possible amendments to the provisions for elections to the Council,

NOTING WITH SATISFACTION that the needed revisions in the IMO Convention have all been initiated within the Organization and have been considered in a spirit of goodwill and mutual accommodation and adopted with the general agreement of Members,

HAVING CONSIDERED the amendments to the IMO Convention recommended by the Ad Hoc Working Group on Elections to the Council and approved by the Council at its sixty-ninth session,

1- ADOPTS amendments to Articles 16,17 and 19 of the Convention on the International Maritime Organization, the texts of which are contained in the annex to this resolution:

2- REQUESTS the secretary- General of the Organization to diposit the adopted amendments with the Secretary - General of the United Nations in accordance with Article 67 of the IMO Convention and to receive instruments of acceptance and declarations as proviced for in Article 68: and

3-INVITES the Members of the Organization to accept these amendments at the earliest possible date after receiving copies thereof by communicating the appropriate instrument of acceptance to the Secretary - General in accordance with Article 68 of the Convention.

AMENDMENTS TO THE CONVENTION ON THE

INTERNATIONAL MARITIME ORGANIZATION

PART VI

the Council

Article 16

Replace text of Article 16 by:

"the Council shall be composed of forty Members elected by the Assembly".

ARTICLE 17

Replace text of Article 17 by:

"In electing the Members of the Council, the Assembly shall observe the following criteria"

(a) Ten shall be States with the largest interest in providing international shipping services;

(b) Ten shall be other Stetes with the largest interest in international seaborne trade;

(c) twenty shall be States not elected under (a) or (b) above which have special interests in maritime transport or navigation, and whose election to the Council will ensure the representation of all major geographic areas of the world".

ARTICLE 19 (b)

replace text of Article 19 (b) by:

"(b) Twenty -six Members of the Council shall constitute a quorum".
