Memorandum of Understanding concerning ELB private sector lending in Lebanon

Memorandum of Understanding concerning ELB private sector lending 1- The overall objective of this Memorandum of Understanding is to set the framework for EIB private sector lending in the Republic of Lebanon.

2- One of the EIB’s long-term strategic objectives for the Mediterranean region, as defined under the Facility for Euro-Mediterranean Investment and Partnership (FEMIP), is supporting the divestment in the Mediterranean Partner Countries, Particular emphasis is placed on promoting local investment projects that are technically, economically and environmentally justified and that support sustainable job creation thereby contributing to well-balanced and well distributed economic growth.

3- Lebanon is a target country for EIB’s private sector lending under FEMIP in the Near East region, given the strong potential and human capital it has today to mobilise and attract private sector investment, domestically, regionally and internationally.

4- The Framework Agreement (FA) signed on 10 September 1997 between the Republic of Lebanon, represented by the CDR, and the EIB which was subsequently ratified by the Lebanese Parliament on 14 June 1999, covers all projects financed by the EIB provided that the projects (i) are located on the territory of the Lebanese Republic and (ii) the Republic of Lebanon has requested or consented that the EIB finances the project (Article 1 of the FA).

5- So far, the EIB has financed public sector projects in Lebanon under the FA. Nonetheless, the provisions of the FA, and the orientations of the FEMIP programme, mean that Bank financing of private sector projects under the FA are also envisaged and are expected to commence shortly.

6- Developing private sector lending under the FA will not alter the public sector lending activity of the EIB in Lebanon; public sector lending through the CDR will continue to constitute the core of EIB lending in Lebanon.

7- The coverage of private sector lending under the FA is an essential condition to enable the EIB to provide long-term financing for domestic private sector investment projects in Lebanon.

8- The inclusion of private sector lending under the remit of the FA does not and can not constitute a contingent liability or financial commitment for the Republic of Lebanon towards the EIB. Rather, it assures the EIB that the basic legal framework it needs to operate outside the European Union is respected.

9- For all private sector projects to be signed by the EIB under the FA, the EIB will inform the CDR in advance of the identity of borrower and the purpose, size and maturity of the loan.

10- The Republic of Lebanon, acting through the CDR, will then consent to the financing of EIB loan under the FA.
