مع الاحتفاظ بتطبيق احكام الباب السابق يعتبر في حالة الافلاس كل تاجر ينقطع عن دفع ديونه التجارية, وكل تاجر لا يدعم الثقة المالية به الا بوسائل يظهر بجلاء انها غير مشروعة.
