المادة 205

اذا ثبتت عدة جنايات او جنح قضي بعقوبة لكل جريمة ونفذت العقوبة الاشد دون سواها.

على انه يمكن الجمع بين العقوبات المحكوم بها بحيث لا تزيد مجموع العقوبات الموقتة على اقصى العقوبة المعينة للجريمة الاشد الا بمقدار نصفها.

اذا لم يكن قد قضي بادغام او بجمع العقوبات المحكوم بها احيل الامر على القاضي ليفصله.

Art. 205: En cas de conviction de plusieurs crimes ou delits, une peine sera prononcee pour chaque infraction et la peine la plus forte sera seule subie.

Le cumul des peines prononcees pourra cependant etre ordonne sans que la duree totale des peines temporaires d'epasse de la moitie le maximum de la peine applicable a l'infraction la plus grave. S'il n'a pas ete statue sur la confusion ou le cumul des peines prononcees au cours d'une ou de plusieurs poursuites, le juge sera saisi pour etre ordonne ce qu'il appartiendra.

لمرة واحدة وحصراً ولدواعي تطبيق هذا القانون تُعدل المادة ٢٠٥ من قانون العقوبات لتصبح

على النحو التالي:

باستثناء المحكومين بعقوبة الإعدام أو المؤبد التي لا تخضع للجمع، إذا ثبتت عدة جنايات أو جنح قضي بعقوبة لكل جريمة ونفذت العقوبة الأشد دون سواها.

على أنه يمكن الجمع بين العقوبات المحكوم بها بحيث لا تزيد مجموع العقوبات المؤقتة على أقصى العقوبة المعينة للجريمة الأشد إلا بمقدار ربعها.
