المادة 39

لكل اجير الحق في اجازة سنوية خمسة عشر يوما باجر كامل بشرط ان يكون مستخدما في المؤسسة منذ سنة على الاقل.

لرب العمل ان يختار تاريخ هذه الاجازات بحسب مقتضيات الخدمة وليس له ان يصرف الاجير ولا ان يوجه اليه علم الصرف خلال الاجازة.

Art. 39. Tout salarié employé dans un établissement depuis un an au moins a droit à un congé annuel de quinze jours avec plein salaire.

L'employeur peut choisir la date de ces congés d'après les nécessités du service. L'employeur ne peut licencier le salarié ni lui adresser le préavis de licenciement pendant la durée du congé.
