The Labour Code caps work at 48 hours a week outside agriculture; the Minister may vary this, and emergency work may reach 12 hours with notice and 50% overtime pay. It gives a midday break of at least 1 hour, 9 hours' daily and 36 hours' weekly rest, 15 days' paid annual leave after a year, sick leave by service, and 10 weeks' paid maternity leave. The holiday decree covers public bodies; for private firms it fixes only the day after Labour Day when 1 May falls on a Sunday or holiday, and defers to separate Labour Day and Independence Day laws.

How many hours a week can a worker be made to work?
Article 31 of the Labour Code caps the week at 48 hours, except in agriculture. Article 32 lets the Minister of National Economy cut hours in arduous or unhealthy work, or raise them in cases such as restaurants and cafés.
In emergencies, Article 33 allows 12 working hours. The employer must respect paragraphs 2 and 3 of Article 23 and inform the Social Affairs service within 24 hours. Emergency overtime is paid 50% above ordinary hourly pay.
The texts we hold set no overtime rate for ordinary full-time work. Flexible work is not covered here.
What breaks and rest does a worker get?
When the working day exceeds 6 hours for men or 5 for women, the employer must give a midday break of at least 1 hour. Workers get 9 consecutive hours of rest in every 24, unless work conditions require otherwise.
Weekly rest is at least 36 uninterrupted hours for all workers. The employer picks the day and may spread it among workers.
How much paid annual leave does a worker get?
Annual leave is 15 days at full pay, after at least a year in the establishment. The employer sets the dates and may not dismiss the worker or give notice of dismissal during the leave.
Children and juveniles have separate rules on hours and leave, not covered here.
How much sick leave does a worker get?
Article 40 covers illness other than work-related illness and work accidents. Each step gives equal time at full and half pay. No figure is given for service under 3 months.
This page does not cover the medical report, dismissal during sick leave, bereavement leave or Social Security sickness pay.
| Service | Full pay | Half pay |
|---|---|---|
| 3 months to 2 years | Half a month | Half a month |
| Over 2 to 4 years | 1 month | 1 month |
| Over 4 to 6 years | 1 and a half months | 1 and a half months |
| Over 6 to 10 years | 2 months | 2 months |
| Over 10 years | 2 and a half months | 2 and a half months |
How long is maternity leave, and who pays?
Article 28 of the Labour Code, as now worded, gives women workers in all categories 10 weeks' maternity leave around the birth, on a medical certificate of the expected date.
A woman on maternity leave gets her full wage and keeps that year's paid annual leave under Article 39. She may not be dismissed or given notice unless proved to have worked elsewhere.
Article 26 of the Social Security Law gives an insured woman an allowance for the 10 weeks in which the birth falls, if she stops work and receives no wage. The texts we hold do not say how this fits with the full wage.
Art. 26
Which public holidays are days off, and what if one falls on a Sunday?
Decree 15215/2005 sets holidays for public administrations, public institutions and municipalities. Under its Article 4, a holiday falling on a Sunday or another holiday is not replaced by another day.
Art. 4 مرسوم رقم 15215 تاريخ 27/09/2005
إذا صادف وقوع العيد أو المناسبة يوم أحد أو يوم عطلة، لا يستعاض عنه بيوم آخر.
For private firms, Labour Day is an exception. When 1 May falls on a Sunday or a holiday, private-sector establishments close the next day. Hospitals, pharmacies, bakeries and restaurants are exempt and pay double wages to those who work that day.
The decree applies subject to the 30/4/1959 law on Labour Day and the 21/11/1962 law on compulsory closure of commercial and industrial establishments on Independence Day. We do not hold either law.
