المادة 56
الموجب التخييري هو الذي يكون موضوعه مشتملا على جملة اشياء تبرأ ذمة المديون تماما باداء واحد منها وللمديون وحده حق الاختيار ما لم يكن ثمة نص مخالف.
Art. 56 - Il y a obligation alternative, lorsque l’obligation a pour objet plusieurs prestations, mais que le débiteur se libère entièrement en fournissant une seule d’entre elles.
Sauf stipulation contraire, il appartient au seul débiteur de choisir celle-ci.
