لا يجوز ابطال القسمة سواء أكانت اتفاقية ام قانونية ام قضائية الا بسبب الغلط او الاكراه او الخداع او الغبن.
Art. 947 - Le partage, soit conventionnel, soit légal, soit judiciaire, ne peut être annulé que pour erreur, violence, dol ou lésion.
