المادة 152
يمنح العفو الخاص رئيس الدولة بعد استطلاع رأي لجنة العفو, لا يمكن المحكوم عليه ان يرفض الاستفادة من العفو, يمكن ان يكون العفو شرطيا وان يناط بموجب واحد من الموجبات المعينة في المادة ال 70 او بأكثر, اذا كان الفعل المقترف جناية وجب التعويض على المدعي الشخصي بمقتضى الفقرة الثالثة من المادة ال 170 في مهلة اقصاها ثلاث سنوات .
Art. 152: La grace est accordee par le Chef de l'etat apres avis de la commission des graces.
Le condamne ne peut en refuser le benefice. Elle peut etre conditionnelle.
Elle peut notamment etre subordonnee a une ou plusieurs des obligations prevues a l'article 170.
Lorsque le fait commis est un crime, de delai maximun dans lequel la partie civile doit etre dedommagee par application de l'article 170-3 sera de trois ans.
