المادة 375
كل موظف غير الذين ذكرتهم المادة ال 306 عزل او كفت يده وكل شخص ندب الى خدمة عامة بالانتخاب او بالتعيين وانتهت مدته يعاقب بالحبس من ثلاثة اشهر الى ثلاث سنوات اذا مضى في ممارسة وظيفته خلافا للقانون.
Art. 375: Tout fonctionaire autre que ceux vises a l'article 306 qui aura ete revoque ou suspendu, toute personne investie d'un mandat public par voir d'election ou par voie de nomination dont le mandat aura pris fin, s'il continue ilegalement l'exercice de ses fonctions, sera puni de trois mois a trois ans d'emprisonnement.
