(كما تعدلت بالمرسوم الاشتراعي رقم 116 تاريخ 12/6/1959):
لا يجوز فتح المحلات الداخلة في الصنفين الاول والثاني الا بترخيص من المحافظ.
اما المحلات الداخلة في الصنف الثالث فيرخص بفتحها القائمقام ويجب على الدوام ان يقدم الطلب او التصريح قبل انشاء المحل.
