المادة 97

اذا لم يقم المالك خلال المدة المعينة في المادة السابقة باعمال التحريج المطلوب فيكون للدولة الحق: اما في استملاك هذه الارض وبيعها بالمزاد العلني من الغير لتحريجها وفقا لاحكام المادة السابقة.

واما في القيام بتحريجها على نفقتها وباستيفاء مصارفات التحريج وغيره من ايراد الارض المحرجة عن طريق وضع يدها عليها المدة اللازمة لاستيفاء قيمة هذه المصارفات.

تكون قيمة المصارفات دينا ممتازا للخزينة وتقيد في السجل العقاري بمثابة تأمين اجباري على الارض المتعلق بها يمكن تطبيق التدبير الاخير على الاملاك المشاعية.
