المادة 3
للقاضي عند انتفاء النص , ان يفصل فيما اذا كان الواجب المعنوي يتكون منه موجب طبيعي او لا ولا يمكن ان يكون الموجب الطبيعي مخالفا لقاعدة من قواعد الحق العام.
Art. 3 - En cas de silence du législateur, il appartient au juge d’apprécier si un devoir moral constitue une obligation naturelle.
Il n’y a pas d’obligation naturelle possible contre une règle d’ordre public.
