المادة 949
ان ابطال القسمة للاسباب التي عينها القانون يرجع كلا من المتقاسمين الى الحال التي كان عليها من الوجهة القانونية والعملية عند حصول القسمة, مع مراعاة الحقوق التي اكتسبها شخص ثالث حسن النية وفاقا للاصول ومقابل بدل ويجب ان تقام دعوى الابطال في السنة التي تلي القسمة, ولا تقبل بعد انقضائها.
Art. 949 - L’annulation du partage, pour les causes établies par la loi, remet chacun des copartageants dans la situation de droit et de fait qu’il avait au moment du partage, sauf les droits régulièrement acquis, à titre onéreux, par les tiers de bonne foi.
L’action en nullité doit être intentée dans l’année qui suit le partage; elle n’est pas recevable après ce délai.
