في حالة التكرار, يجب ان يكون القرار المانح الاسباب المخففة معللا تعليلا خاصا سواء في الجنايات او الجنح او المخالفات.
Art. 256: En cas de recidive, la decision accordant les ciconstances attenuantes devra etre specialement motivee qu'il s'agisse d'un crime, d'un delit ou d'une contravention.
