المادة 748
يقضى بالعقوبة نفسها على من:
1- سيّل في المياه العمومية الممنوح بها امتياز ام لا او سكب او رمى فيها سوائل او مواد ضارة بالصحة او الراحة العامة او مانعة من حسن الانتفاع بهذه المياه.
2- القى اسمدة حيوانية او وضع اقذارا في الاراضي الداخلة ضمن النطاق الذي حددته السلطة لحماية نبع تنتفع منه العامة,
3- اجرى اي عمل من شأنه تلويث النبع او المياه التي يشرب منها الغير.
Art. 748: Sera puni des memes peines quiconque aura:
1- laisse ecouler, repandu ou jete dans les eaux du domaine public, concedees ou non, des liquides ou subst- ances susceptibles de nuire a la salubrite, a la common- dite publique ou a la bonne utilisation de ces eaux;
2- Epandu des engrais d'origine animale ou depose des immondices sur les terrains compris dans le perimetre, determine par l'autorite, de protection d'une source servant a l'alimentation publique;
3- Commis un fait quelconque de nature a causer la pollution des sources et eaux servant a l'alimentation d'autrui.
