المادة 138
كل جريمة تلحق بالغير ضررا ماديا كان او معنويا تلزم الفاعل بالتعويض , تجب الالزامات المدنية على فاعل الجريمة الذي استفاد من احد اسباب الاعفاء,
Art. 138: Toute infraction qui cause a autrui un dommage soit materiel, soit moral, oblige son auteur a reparation.
L'auteur d'une infraction qui beneficie d'une cause de non imputabilite n'echappe pas aux sanctions civiles.
