المادة 216
مفاعيل الاسباب المادية التي من شأنها تشديد العقوبة او تخفيضها او الاعفاء منها تسري على كل من الشركاء في الجريمة والمتدخلين فيها.
وتسري عليهم ايضا مفاعيل الظروف المشددة الشخصية او المزدوجة التي سهلت اقتراف الجريمة.
واما ما سوى ذلك من الظروف فلا يتناول مفعولها الا الشخص الذي تتعلق به.
Art. 216: Les circonstances reelles entrainant aggravation, attenuation ou exemption de peine ont effet a l'egard de chacun des co-auterus de l'infraction et de leurs complices.
Il en est de meme des circonstances aggravantes personnelles ou mixtes qui ont servi a faciliter l'infraction.
Toute autre circonstance n'a effet qu'a legard de la personne qu'elle concerne.
