و

حكومة الجمهورية اللبنانية

بشأن التعاون في مجال الدفاع

إن وزير الدفاع في مملكة هولندا ووزير الدفاع الوطني في الجمهورية اللبنانية، والمشار إليهما فيما بعد بـ «الطرفين»؛

ورغبة في تعزيز تطوير العلاقات الجيدة بينهما على أساس الاحترام المتبادل للمصالح، والمعاملة بالمثل، والشراكة؛

وإدراكا لأهمية التعاون الدفاع بين الطرفين؛

وفي روح من الانفتاح والتفاهم المتبادل، وفي إطار القوانين والأنظمة المعمول بها لدى الطرفين؛

ونظرا للترتيب التقني المبرم بين وزير الدفاع في مملكة هولندا ووزير الدفاع الوطني في لبنان بشأن التعاون في مجال الدفاع، والذي دخل حيز التنفيذ بتاريخ ٢٠ تموز ٢٠٢٣؛

وإذ يعتبران أن هذه المذكرة تشكل مذكرة تفاهم عامة بينهما؛

فقد توصلا الى التفاهم التالي:

المادة الأولى

الغاية والنطاق

١. تهدف هذه المذكرة إلى وضع الإطار اللازم للتعاون الدفاعي المستقبلي بين الطرفين.

٢. يقوم الطرفان بإقامة علاقات متبادلة في قطاع الأمن بهدف تعزيز التعاون في المجالات ذات الصلة.

٣. يتعاون الطرفان في مجال الدفاع عند تنفيذ مسؤولياتهما المنصوص عليها في هذه المذكرة على أساس المساواة والمعاملة بالمثل.

٤. يتيح هذا التعاون للطرفين عقد اجتماعات دورية، ومناقشة القضايا ذات الاهتمام المشترك، والاستفادة المتبادلة من المشاريع التي تلبي احتياجات كل طرف.

٥. تحدد هذه المذكرة المبادىء التي تحكم التعاون الدفاعي المذكور أعلاه.

المادة الثانية

المساعدة المتبادلة

١. ينوي الطرفان تبادل الجهود وتقديم الدعم لبعضهما البعض في تنفيذ الأنشطة التي تشملها هذه المذكرة.

٢. يتم تحديد الشروط الخاصة بالمساعدة المتبادلة مسبقاً وبحسب كل حالة على حدة.

٣. كما سيتم تبادل المعلومات والمسائل المتعلقة بالسلامة بين الطرفين.

المادة الثالثة

مجالات التعاون الدفاعي

يشمل التعاون بين الطرفين التبادل المنتظم للمعلومات والمشاركة في المجالات التالية:

١. التدريب والتعليم للعسكريين والمدنيين؛

٢. التعاون في مجالات مثل التعاون المدني العسكري، الإدارة المتكاملة للحدود، وإزالة الألغام؛

٣. هيكلية الوحدات متعددة الجنسيات وتدريبها؛

٤. تنظيم ومهام الخدمات المختلفة للقوات المسلحة من النواحي اللوجستية؛

٥. التشريعات والأنظمة الوطنية والدولية المتعلقة بالدفاع الوطني والخدمات المختلفة للقوات المسلحة؛

٦. التاريخ العسكري؛

٧. الأنشطة الطبية؛

٨. الوقاية من الكوارث وعمليات الإغاثة؛

٩. الأنشطة الثقافية والرياضية؛

١٠. إدارة الحدود ومهام الشرطة العسكرية؛

١١. وأي مجال آخر يتم الاتفاق عليه بين الطرفين.

المادة الرابعة

أشكال التعاون

يتم التعاون بين الطرفين بشكل رئيسي عبر:

١. الزيارات المتبادلة، والمؤتمرات، والندوات؛

٢. الدراسات والمشاركة في الدورات ضمن المؤسسات التعليمية العسكرية؛

٣. تبادل الأفراد والممثلين من الوحدات العسكرية والخدمات المختلفة بغرض التخطيط للتمارين المشتركة؛

٤. التدريب المتبادل للوحدات؛

٥. الاجتماعات بين مجموعات الأركان من الوحدات العسكرية وممثلي المؤسسات التعليمية العسكرية.

المادة الخامسة

اللجنة العسكرية المشتركة

١. يتم إنشاء لجنة عسكرية مشتركة لبنانية - هولندية على مستوى مدير التعاون العسكري الدولي، بهدف تنظيم وتنسيق التعاون الثنائي في المجال العسكري.

٢. تعقد اللجنة العسكرية المشتركة اجتماعا كل سنتين لتنفيذ التعاون الدفاعي من خلال الاتفاق على البرامج السنوية، ويمكن عقد الاجتماعات رقميا وتعتبر هذه البرامج مكملة لهذه المذكرة.

٣. يجوز إدراج أي موضوع يعزز التعاون الثنائي على جدول أعمال اللجنة بعد موافقة الرئيسين المشتركين.

٤. تراجع اللجنة الأنشطة المنفذة في السنة السابقة وتضع خطة التعاون الثنائي للسنة التالية.

٥. تشمل خطة التعاون الثنائي الأنشطة المتفق عليها، مواضيعها، أساليبها، مواعيدها، أماكنها، والجهات المسؤولة عن تنفيذها ويوقع الرئيسان المشتركان المخولان أصولا على خطة التعاون الثنائي.

٦. يتم تبادل جميع المراسلات المتعلقة بالتعاون في إطار هذه المذكرة عبر السفارات أو مكاتب الملحقين الدفاعيين.

المادة السادسة

حماية البيانات الشخصية

١. يُسمح بتبادل البيانات الشخصية فقط عندما يكون ذلك ضروريا لتنفيذ هذه المذكرة.

٢. تعالج البيانات الشخصية بشكل عادل ومشروع وشفاف بالنسبة لصاحب البيانات.

٣. تجمع البيانات فقط لأغراض محددة ومشروعة تتعلق بتنفيذ هذه المذكرة، ولا تستخدم لاحقا لأي غرض آخر غير متوافق مع الغرض الأساسي.

٤. يجب أن تكون معالجة البيانات الشخصية كافية

وذات صلة ومحدودة بما هو ضروري للأغراض التي جمعت من أجلها ويعالج الطرف المتلقي البيانات الطبية لأفراد الطرف المرسل فقط للأغراض المتفق عليها في هذه المذكرة.

٥. يسلّم الطرف المتلقي السجلات الطبية إلى الطاقم الطبي للطرف المرسل دون تأخير عند انتهاء الحاجة إليها، ويحذف جميع البيانات الطبية المعالجة خلال ٣٠ يوما من استكمال الإجراءات الرسمية.

المادة السابعة

التنفيذ

١. من أجل تنفيذ أحكام هذه المذكرة، يجوز للطرفين إبرام ترتيبات تنفيذية (IAs) للأنشطة المحددة ضمن هذه المذكرة وتشير هذه الترتيبات إلى المذكرة وتطبق أحكامها عليها.

٢. ينفذ التعاون الدفاعي بناء على الأنشطة التي يحددها الطرفان، ويمكن للطرفين تقديم مقترحات عملية تُتبادل عبر القنوات المتفق عليها.

المادة الثامنة

الوضع القانوني

١. سيبرم اتفاق منفصل بين الجمهورية اللبنانية ومملكة هولندا بشأن وضع الأفراد، ويطبق على أي نشاط يتم الاتفاق عليه ضمن إطار التعاون الدفاعي حال دخوله حيز التنفيذ.

٢. عند دخول هذه المذكرة حيز التنفيذ، يتم تحديد وضع الأفراد عبرمذكرة شفوية (Note Verbale).

المادة التاسعة

الأحكام المالية

يتحمل كل طرف نفقاته الخاصة المتعلقة بتنفيذ هذه

المذكرة، ما لم يتفق الطرفان على خلاف ذلك في ترتيبات لاحقة.

المادة العاشرة

الإشعارات ونقاط الاتصال

يتولى تنفيذ هذه المذكرة الأقسام المختصة ضمن الوزارتين المعنيتين.

نقاط الاتصال لتنفيذ هذه المذكرة هي:

- عن وزير الدفاع الوطني في لبنان: مدير التعاون العسكري الدولي / أركان الجيش للتخطيط.

- عن وزير الدفاع في مملكة هولندا: مدير التعاون العسكري الدولي في رئاسة أركان الدفاع.

المادة الحادية عشرة

تسوية النزاعات

يُحل أي خلاف يتعلق بتفسير أو تنفيذ هذه المذكرة عن طريق التشاور فقط بين الطرفين، ولا يحال إلى أي محكمة وطنية أو دولية أو إلى أي طرف ثالث.

المادة الثانية عشرة

الأحكام الختامية

١. لا تنشىء هذه المذكرة أي حقوق أو التزامات بموجب القانون الدولي.

٢. ولا يجوز نشرها للعامة دون موافقة خطية من الطرفين.

٣. تدخل هذه المذكرة حيز التنفيذ من تاريخ توقيعها وتبقى سارية لأجل غير محدد.

٤. يجوز لأي من الطرفين إنهاؤها بإشعار خطي قبل ثلاثة أشهر من الطرف الآخر.

٥. يمكن تعديل هذه المذكرة أو استكمالها في أي وقت بموافقة خطية متبادلة بين الطرفين، وتصبح التعديلات نافذة من تاريخ التوقيع الأخير.

Memorandum of Understanding

Between

The Government of the Kingdom of the Netherlands

and

The Government of Lebanon

Concerning

Defence Cooperation

The Minister of Defence of the Kingdom of the Netherlands and the Minister of National Defence of Lebanon, hereinafter, referred to as ‘the Participants’;

Willing to further enhance the development of good relations between the Participants based on mutual respect of their interests, reciprocity and partnership;

Recognizing the importance of defence cooperation between the Participants;

In a spirit of openness and mutual understanding and within the framework of the applicable legislation and regulations of the Participants;

CONSIDERING the Technical Arrangement between the Minister of Defence of the Kingdom of the Netherlands and the Minister of National Defence of Lebanon on Cooperation in the Field of Defence, which entered into effect on ۲۰ July ۲۰۲۳;

Determining that this Memorandum of Understanding (MOU) serves as a general MOU between the Participants;

Have reached the following understanding:

Section ۱

Purpose And Scope

۱. The purpose of this MOU is to create the framework necessary for future defence cooperation between the Participants.

۲. The Participants will set up mutual relations within the security sector to establish cooperation in relevant areas.

۳. The Participants will cooperate in the field of defence by performing their responsibilities as set out in this MOU on the basis of equality and reciprocity.

٤. The aforementioned defence cooperation will enable the Participants to hold periodical meetings, to discuss issues of mutual interest and to mutually benefit from selected projects which may satisfy each Participant’s needs.

٥. This MOU sets out the principles governing the aforementioned defence cooperation.

Section ۲

Mutual Assistance

۱. The Participants intend to share the efforts and to support each other in performing activities which are covered by this MOU.

۲. The Participants will determine, in advance, on case by case basis, the specific terms concerning mutual assistance.

۳. Safety issues and information will be shared between the Participants.

Section ۳

Fields Of Defence Cooperation

Cooperation between the Participants will comprise of a regular exchange of information and or participation in the following areas:

۱. Training and education of military and civilian personnel;

۲. Cooperation in areas such as Civil Military Cooperation, Integrated Border Management and demining;

۳. Organizational structure of multinational units and their training;

٤. Organization and logistic tasks of the different services of the armed forces;

٥. Legislation, national and international regulations concerning the national defence and different services of the armed forces;

٦. Military history;

۷. Medical activities;

۸. Disaster prevention and relief operations;

۹. Cultural and sports activities.

۱۰. Border management and military police tasks.

۱۱. Any other area as mutually decided by the Participants.

Section ٤

Forms Of Cooperation

Cooperation between the Participants will take place (mainly) in the form of:

۱. Mutual visits, conferences and seminars;

۲. Studies as well as participations in courses in the military educational institutions;

۳. Exchange of the staffs and their representatives from the military units and the different services of the armed forces, for the purpose of planning of common exercises;

٤. Mutual training of units;

٥. Meetings between the groups of the staffs from military units of the different services of the armed forces and the delegations of the military educational institutions.

Section ٥

Military Joint Committee

۱. A Dutch-Lebanese Military Joint Committee, on the level of the director of International Military Cooperation, will be established for the purpose of organizing and coordinating the bilateral cooperation in the military field.

۲. This Military Joint Committee will meet once every two years to realise the defence cooperation by agreeing respective annual programs. These meetings can be held digitally.These programs will supplement this MOU.

٣. Any topic which promotes the bilateral cooperation can be included on the agenda of the Dutch-Lebanese Military Joint Committee session, after the prior approval of the two co-presidents.

٤. The Dutch-Lebanese Military Joint Committee reviews the activities of the previous year and sets forth the Bilateral Cooperation Plans for the next year.

٥. The Bilateral Cooperation Plan includes the activities agreed upon, their topics, ways and dates, the location as well as the institutions responsible for their accomplishment; the duly authorized co-presidents of the Dutch-Lebanese Military Joint Committee, sign the Bilateral Cooperation Plan.

٦. All correspondence pertinent to cooperation within the context of this MOU will be transmitted between the points of contact through the Embassies/Defence Attachés.

Section ٦

Personal Data Protection

١. The communication of personal data will only take place if such communication is strictly necessary for the implementation of this MOU.

٢. Personal data will be processed fairly and lawfully, and in a transparent manner in relation to the data subject.

٣. Personal data will be collected for the specified, explicit, and legitimate purpose of implementing this MOU, and will not be further processed by the receiving Participant in a way incompatible with that initial purpose.

٤. The processing or use of personal data will be adequate, relevant, limited to, and not exceed what is necessary for the purposes for which that data was collected and/or further processed.

٥. The receiving Participant will only process medical data of the personnel of the sending Participant for the purposes agreed in this MOU. The receiving Participant will hand over the kept medical records to medical staff of the sending Participant without delay when no further assistance is needed. After the settlement of formalities, the receiving Participant will delete all the processed (medical) data of sending Participant's personnel within ٣٠ days.

Section ٧

Implementation

١. In order to implement the provisions of this MOU, the Participants may conclude Implementing Arrangements (IAs) for the specific activities to be conducted under this MOU. The IAs will refer to this MOU and this MOU will accordingly apply to any such IAs between the Participants.

٢. The defence cooperation will be carried out on the basis of activities to be determined by the Participants. The Participants may make concrete proposals, which will be exchanged through the channels as decided by the Participants.

Section ٨

Status

١. A separate agreement will be concluded between the Republic of Lebanon and the Kingdom of the Netherlands concerning the status of the personnel, which, as soon as it enters into force, will be applicable to any (mutually agreed upon) activities in the framework of Defence cooperation.

٢. Until the agreement as mentioned in paragraph ١ enters into force, the status of the personnel will be determined by means of a note verbale.

Section ٩

Financial Provisions

Each Participant will cover its own expenses relating to the implementation of this MOU, unless the Participants mutually decide otherwise in subsequent arrangements.

Section ١٠

Notices

The Participants entrust the implementation of this MOU by the respective divisions within the Ministries. The Points of Contact for the implementation of this MOU are as follows:

For the Minister of Defence of the Kingdom of The Netherlands:

Section ١١

Settlement Of Disputes

Any dispute regarding the interpretation or implementation of this MOU is settled only by consultation between the Participants and is not to be referred to any national or international tribunal or court or any other third party for settlement.

Section 12

Final Provisions

1. This MOU does not create any rights or obligations under international law.

2. This MOU cannot be released to the public without written consent from both Participants.

3. This MOU will come into effect on the date of the signature and will remain in effect for an indefinite duration.

4. This MOU may be terminated by either Participant giving three months written notice to the other Participant.

5. This MOU may be amended or supplemented at any time in writing by mutual consent of the Participants. In that case, amendments or supplements will come into effect on the date of the last signature of the amendment or supplement.
