المادة 26
1- ترصد في باب احتياطي الموازنة:
آ- اعتمادات احتياطية للنفقات المشتركة بين عدة وزارات , كمساعدات المرض والوفاة والاحكام النقدية والمصالحات الخ...
ب - اعتماد احتياطي للنفقات الطارئة, يستعمل لتغذية بنود الموازنة التي نفذت اعتماداتها, او لفتح اعتمادات استثنائية, على ان لا يقل هذا الاعتماد الاحتياطي عن واحد بالمئة من مجموع اعتمادات الجزئين الاول والثاني من الموازنة.
2- في حال نفاذ الاعتمادات المرصدة للاحكام النقدية والمصالحات يجوز للحكومة ان تفتح بمرسوم يتخذ في مجلس الوزراء الاعتمادات التكميلية اللازمة وان تغطى هذه الاعتمادات بمأخوذات من مال الاحتياط تصدق بقانون قطع الحساب . وتطبق ايضا احكام هذه الفقرة في حال نفاذ الاعتمادات المرصدة لمعاشات التقاعد وتعويضات الصرف من الخدمة.
3- لا تصرف اية نفقة من اعتمادات هذا الباب مباشرة, بل تنتقل هذه الاعتمادات عند الحاجة الى سائر بنود الموازنة على الوجه التالي:
- بقرار من وزير المالية, بناء على اقتراح الادارة المختصة, وبعد تأشير المراقب المركزي لعقد النفقات , فيما يتعلق بالاعتمادات المذكورة في المقطع "أ" من الفقرة السابقة.
- بمرسوم يصدر بناء على اقتراح الوزير المختص ووزير المالية, فيما يتعلق بالاعتمادات المذكورة في المقطع "ب " من الفقرة السابقة.
