اذا كان المتضرر قد اقترف خطأ من شأنه ان يخفف الى حد ما تبعه خصمه لا ان يزيلها, وحب توزيع التبعة على وجه يؤدي الى تخفيض بدل العوض الذي يعطى للمتضرر.
Art. 135 - Lorsque la victime avait commis une faute qui, sans faire disparaître la responsabilité de son adversaire, l’atténue plus ou moins, il y a lieu de procéder à un partage de responsabilité de traduisant par la modération de la réparation allouée à la victime.
