المادة 218
يتعرض المحرض لعقوبة الجريمة التي اراد او تقترف سواء كانت الجريمة ناجزة او مشروعا فيها او ناقصة.
اذا لم يقض التحريض على ارتكاب جناية او جنحة الى نتيجة خففت العقوبة بالنسبة التي حددتها المادة ال 220 في فقراتها ال 2 وال 3 وال 4.
التحريض على ارتكاب مخالفة لا يعاقب عليه اذا لم يلق قبولا.
تنزل التدابير الاحترازية بالمحرض كما لو كان فاعل الجريمة.
Art. 218: L'instigateur encourt la peine de l'infraction qu'il se proposait de faire commettre, que celle-ci ait ete consommee, tentee ou manquee.
Si l'instigation a commettre un crime ou un delit n'a pas ete suivie d'effet, la peine sera reduite dans la mesure etablie par l'article 220, 2 a 4 alineas.
L'instigation a commettre une contravention qui n'a pas ete agreee n'est pas punisable. Les mesures de surete sont applicable a l'instigateur comme s'il avait ete l'auteur de l'infraction.
