المادة 211
ان الخوف لا يفسد الرضى الا اذا كان هو الحامل عليه. وللوقوف على ماهيته وتأثيره يجدر الاعتداد بشخصية المكره (كالنطر الى سنه او الى كونه امرأة او رجلا والى درجة تعليمه ومنزلته الاجتماعية).
Art. 211 - La crainte ne vicie le consentement que si elle a été déterminante. Pour apprécier sa nature et son influence, il y a lieu de tenir compte de la personnalité de la victime (âge, sexe, instruction, condition sociale).
