المادة 254

اذا اخذت المحكمة بالاسباب المخففة لمصلحة من ارتكب جنحة, فلها ان تخفض العقوبة الى حدها الادنى المبين في المواد ال 51 و 52 و53, ولها ان تبدل الغرامة من الحبس ومن الاقامة الجبرية, او ان تحول في ما خلا حالة التكرار العقوبة الجناحية الى عقوبة تكديرية بقرار معلل.

Art. 254: Lorsque les circonstances attenuantes seront reconnures en faveur de l'auteur d'un delit, le tribunal pourra reduire la peine prevue jusqu'a son minimum legal determine aux 51, 52 et 53.

Il pourra aussi substituer l'amende a l'emprisonnement et a la residence forcee, ou convertir la peine delictuelle par decision motivee et hors le cas de recidive, en une peine contraventionnelle.
